This bill would add a new provision to the California Labor Code, stating that a drayage truck operator is the employee of the entity or person who arranges for or engages the services of the operator for purposes of state laws that govern employment, including workers’ compensation and insurance, occupational safety and health, and provisions that prohibit retaliation or discrimination against employees.
For purposes of the legislation, “drayage truck operator” means the driver of, or any person, party, or entity that controls the operation of, any in-use on-road vehicle with a gross vehicle weight rating greater than 33,000 pounds operating on or transgressing through port or intermodal rail yard property for the purpose of loading, unloading, or transporting cargo, including containerized, bulk, or break-bulk goods.
