Bill S.B. 11

This bill, the Worker Classification Coordinated Enforcement Act, would define misclassification as to classify an individual as something other than an employee, if under the relevant law the individual is required to be classified as an employee.

The bill also would establish a council within the State Labor Commission that must meet quarterly with the Attorney General or Attorney General’s designee to coordinate regulatory and law enforcement efforts related to misclassification.  The council is required to report each year on misclassification issues and may study:

  • How to reduce costs to the state resulting from misclassification;
  • How to extend outreach and education efforts regarding the nature and requirements of classifying an individual;
  • How to promote efficient and effective information sharing amongst the member agencies; and

The need, if any, to create by statute a database or other method to facilitate sharing of information related to misclassification.
