On October 17, 2015, the Coalition presented an update on federal and state developments affecting independent contractors to the American Trucking Association’s Independent Contractor Task Force. Russell Hollrah and Patrick Hollrah presented on behalf of the Coalition.
The discussion on federal developments included an analysis of the U.S. Department of Labor (“DOL”) Administrator’s Interpretation of the economic realities test and other DOL enforcement activities.
The update on state developments included a discussion of enacted legislation which changes the test to determine a worker’s status, affects worker misclassification enforcement, and determines the worker-status of transportation network company drivers.
